Terms and conditions

The present Terms and Conditions regulate the principles of sale and purchase of products offered by the Seller at www.europeanpetgroup.com.

The Seller is “GAB” Publishing Consultant Grzegorz Boguta, REGON 015599755, NIP 521-198-44-50, Świstaka 8, Siedliska, 05-500 Piaseczno. In sales contacts the name GAB Media is used.

§ 1 Definitions

  1. Terms and Conditions – the hereby Terms and Conditions. With regard to e-services, the Terms and Conditions are the terms and conditions referred to in Article 8 of the Act of 18 July 2002 on electronic provision of services (Journal of Laws of 2002 No. 144, item 1204 as amended).
  2. Client (Buyer) – natural person above the age of 13; in the case of persons below the age of 18 the consent of their legal representative is required; also a legal person and an organizational unit without a legal personality to whom a relevant legislative act grants legal capacity and who purchases Products or uses other services offered by the Online Store (including the Consumer, that is a natural person purchasing Products with aims not connected to their economic activity).
  3. Object of the transaction – Products listed and described on the Online Store website. The Seller shall make every effort so that the offer presented on the website is up-to-date. If, however, an Ordered Product happens to be unavailable, the Seller will inform the Client about the shortage as promptly as possible by phone or email.
  4. Product – movable item which is the object of the Sales Agreement.
  5. Additional Service – service provided by the Seller to the Client outside the Online Store due to the specificity of the sold products.
  6. Product – Merchandise and additional Services offered by the Online Store.
  7. Sales Agreement – a legal contract of the sale of goods and services as specified by Polish Civil Code Act, concluded between the Seller and the Client, via means of distance communication (including telephone).
  8. Online Store European Pet Group – online service available at www.europeanpetgroup.com, used by the Client to purchase Products.
  9. Party – the Seller and the Client.
  10. Store Website – each website or subsite available at www.europeanpetgroup.com.
  11. Order – the Client’s statement of intent distinctly specifying the type and amount of Products aiming directly at concluding a Sales Agreement via the Online Store.


§ 2 General provisions

  1. Before placing an Order in the Online Store, the Client must become acquainted with the present Terms and Conditions and accept its provisions during the ordering process.
  2. The EuropeanPetGroup.com online store sells products wholesale and retail via the Internet.
  3. Products offered by the EuropeanPetGroup.com store are brand new, originally packed, free from physical and legal defects, and have been legally introduced to the polish market. 
  4. If the sold Products have been previously used, they will be distinctly labeled by the Seller as secondhand Products.
  5. In order to properly use electronic services, the Buyer is required to possess software enabling Internet access (or a computer with access to the Internet) and use one of the following browsers: Internet Explorer, Google Chrome, Mozilla Firefox, Opera, or Safari, which will guarantee cooperation with the ICT system of the Seller.


§ 3 Placing orders

  1. All prices stated on the www.europeanpetgroup.com website are gross prices given in Euro and Polish zloty (including VAT). Shipment costs varies depending on territory.
  2. We accept online, telephone and email Orders.
  3. Online Orders and Email orders may be placed 24 hours a day, 7 days a week, throughout the whole year. 
  4. The Order shall be effective after the Buyer properly fills in the order form and correctly specifies the contact details, including a detailed address to which the Product is to be shipped, telephone number and email address.
  5. In the event that the provided contact details are incomplete, the Seller shall contact the Buyer in order to complete them. If contact with the Buyer proves impossible, the Seller reserves the right to cancel the Order. 
  6. The Buyer grants consent for issuing and sending an electronic version of accounting documents, such as VAT invoices with attachments, corrective VAT invoices with attachments, or forms to the indicated address. The present consent also entitles the Buyer to issue and send VAT invoices electronically, in accordance with the regulation of the Minister of Finance of December 17th, 2010 regarding the mailing of invoices in electronic form, directives for their storage, and procedures for sharing them with tax authorities or the Treasury Inspection body.
  7. For the purpose of fulfilling the Order and proper shipping of the Product, the Client will be asked to provide their personal data.
  8. After placing an effective order, the Client will receive an automatic response from the store, confirming the acceptance of the Order.
  9. The moment the payment is transferred to the store’s bank account (in the case of payment by bank transfer) or the moment the order is placed (in the case of payment by credit card), the process of Order implementation shall be launched. We do not offer cash-on-delivery sales.


§ 4 Cost and time of delivery

  1. The ordered Products will be shipped to the address indicated in the order form or provided via email or telephone. The Store shall immediately inform the Customer of any errors present in the order form, which would disable or delay the shipment of the Product.
  2. The Product is delivered by means of specialized courier services or the Polish Post (Poczta Polska). In exceptional cases there is the possibility of collecting the Product in person from the Seller’s office.
  3. The Buyer is charged with the costs of delivery (shipment) specified in the shipment pricelist. The costs depend on the chosen type of shipment, mode of payment and destination, all of which may be viewed by clicking on the “Shipping cost” tab.


§ 5 Payment

  1. We issue a nominative invoice for each Product we have sold.
  2. We accept payment by the DotPay electronic payment system, by PayPal, by credit card, by online transfer, or by regular bank transfer.
  3. In the case of chosen types of Products, the Seller reserves the right to restrict the form of payment by excluding certain modes of payment on the store website.


§ 6 Collection of goods

  1. We ship Products to the entire European Union territory and certain countries outside of this region.
  2. Before collecting the shipment from the post office or courier, the Buyer should make sure that the package had not been damaged during transport, verifying especially the state of tapes or seals fastened to the package. If the package is damaged or the seals (or tape) are ripped off, the shipment should not be accepted. The Client should draft a damage report in the presence of the courier and contact the Seller immediately in order to clarify the problem.


§ 7 Withdrawal from the agreement

  1. The Consumer who has concluded the agreement via means of distance communication has the right to cancel the agreement without specifying the cause for doing so. To terminate the agreement, the Consumer must submit a written statement within 10 days of receiving the Product. 
  2. Regulations specified within this article apply to consumer sales.
  3. The Product may be returned exclusively in cases when it is fully complete, free of damages, with no signs of wear indicating that it has been used for purposes other than an overall examination of its quality.
  4. If the Client decides to terminate the agreement, it is the Client who covers the full costs of shipping the Product back to the Seller’s office.
  5. The return shipment should contain a written statement on withdrawal from the agreement as well as the bank account number to which the store is to retransfer the incurred payment.


§ 8 Complaints procedure

  1. All products have a warranty of the producer valid on the territory of Poland. The warranty period for each Product is stated in its description on the store website. The particular conditions of realizing each warranty are specified in the printed version of the warranty, which is issued by the warrant.
  2. The repaired Product is shipped back to the Client at the expense of the Seller.
  3. All deficiencies or non-conformity issues regarding the Products as well as expectations concerning the form of realizing the warranty should be reported to the Seller in written form and send to the Seller’s office at the expense of the latter.
  4. The Client looses the rights specified in the act on specific terms and conditions of consumer sale and amendment to the Civil Code if the deficiencies or non-conformity issues fail to be reported to the Seller in a period of two months counted from the moment of detecting the aforementioned defects.
  5. In the event that a claim or complaint is received the Seller is obliged to respond within 14 days of receipt.


§ 9 Privacy policy and personal data protection

  1. The Seller administers the personal database completed by clients of the online store for the purpose of purchasing products.
  2. The Seller may collect and process personal data of the Buyer for the purpose of concluding or performing the Agreement; therefore, the personal data may be transferred to entities responsible for delivering the purchased Products to the Customer or, in the case of an installment purchase, to institutions that credit the purchase. The Clients have the right to access their personal data and to edit them. Personal data are transferred voluntarily.


§ 10 Final provisions

  1. The following provisions are binding in issues not regulated by the present Terms and Conditions: provisions of the Act of March 2, 2000 concerning protection of certain consumer rights and liability for damage caused by a hazardous product (Journal of Laws of 2000, No 22, item 271 with as amended), the Act of July 27, 2002 on specific terms and conditions of consumer sale and amendments to the Civil Code (Journal of Laws of 2002, No 141, item 1176 as amended), the Act of April 23, 1964 – Civil Code (Journal of Laws of 1964, No 16, item 93 as amended).
  2. Any disputes resulting from the use of these Terms and Conditions and in connection with any agreements concluded between the Store and the Customers, shall be resolved by a competent Court according to the provisions on material and local property pursuant to the Act of 17 November 1964, the Polish Code of Civil Procedure (Journal of Laws No 43, item 296 as amended).
  3. The Seller reserves the right to introduce changes to these Terms and Conditions with the reservation that in the case of agreements concluded before the introduction of changes, the version of the Terms and Conditions binding at the time of placing an order by the Customer shall apply. Regular clients will be notified of any changes 14 days before their introduction.
